Washington— A federal judge on Thursday named US District Judge Raymond Dearie to serve as an independent arbitrator, or special master, charged with reviewing documents seized by the FBI during its search of former President Donald Trump’s home in South Florida.

Trump proposed Dearie for the post last Friday, and Justice Department lawyers told the court on Monday night that they were not opposed to his appointment.

In his role as Special Master, Dearie will be responsible for reviewing records made by the FBI during its August 8 search of Mar-a-Lago for personal items and documents, as well as material that could potentially be subject to claims by attorneys of privileges. client or executive.

On a eight page order naming Dearie as Special Master, U.S. District Judge Aileen Cannon set a November 30 deadline for Dearie to complete his review of seized materials and said Trump is responsible for “100% of the Special Master’s professional fees and expenses and any professional , support staff and expert consultants involved” in your request.

It also set out the special master’s specific duties, including that he conduct a privileged review of records obtained in the search and identify items or personal documents and presidential records in the seized materials. Cannon instructed Dearie and the parties to “prioritize, as a matter of time, documents marked confidential”.

Dearie, 78, was named to the federal bank by President Ronald Reagan in 1986 and served as chief judge of the U.S. District Court for the Eastern District of New York from 2007 to 2011. He assumed senior status, a form of semi-retirement that allows judges to maintain a number of cases in 2011.

After leaving active service, Dearie was appointed by Chief Justice John Roberts to the Foreign Intelligence Surveillance Court for a term of seven years which started in 2012. The court, which meets in secret, considers requests for a US government warrant to approve electronic surveillance and other investigative actions.

Dearie was selected as a special master from a pool of four candidates put forward by the Department of Justice and Trump’s legal team. Lawyers for the former president said on Monday they opposed both candidates proposed by federal prosecutors, retired federal judges Barbara Jones and Thomas Griffith. The Justice Department opposed one of Trump’s two choices, Paul Huck, former general counsel to Florida Governor Charlie Crist, citing his lack of judicial experience in federal cases, including those with national security and privilege concerns.

With Dearie as the Trump-suggested candidate who was a good fit for federal prosecutors, the Justice Department law told Cannon in his Monday filing that he is available to act as a third-party reviewer and could “get the job done quickly.”

Cannon last week authorized the appointment of a special master, granting a request by Trump to appoint a third party to comb through the materials seized by the FBI for anything that could potentially be privileged. She also ordered federal investigators investigating Trump’s handling of confidential government records to stop using any of the documents in his criminal investigation, pending review by the special master.

The Justice Department notified the South Florida federal court last week of its intention to appeal Cannon’s decision.

The order for the administration to temporarily stop reviewing and using the seized materials set off a separate dispute between the Justice Department and Trump’s lawyers. Federal prosecutors last week asked Cannon to partially lift his order to allow investigators to continue reviewing a batch of about 100 records marked “confidential,” “secret” or “top secret,” arguing that the government and the public in will generally be harmed if the materials cannot be reviewed and used in your criminal investigation.

But Trump’s lawyers oppose the Justice Department’s request and urged Cannon in a filing on Monday to continue to bar the FBI from using classified documents in its ongoing investigation. They claimed that some of the records with classification tags can no longer be classified.

Cannon rejected the Justice Department’s request to regain access to nearly 100 documents with classification markings.
