Is the Attorney General Merrick Garland‘exclusive interview with NBC News’ Lester Holt a bomb in which Garland practically yells “LOCK HIM UP!” – or a meaningless collection of boilerplate he has already said? Let’s separate the tomatoes from the tomahtos.

Among the intensification of the chatter triggered by January 6th Audiences, Team Lock Him Up has been on a emotional roller coaster trying to read between the lines of Garland’s investigation. Hopes rise with the explosive revelations and reassuring crackle of Garland, then are dashed by the emergence of a note from may pursue a policy of restricting investigations involving electoral candidates, then rise again other revelations and tantalizing quotes.

Then there’s the other side of the Rorschach test, Team Meh, whose pulse never goes above 80 because everything Garland says is what he’s already said and amounts to a big fancy dodge.

So who scored big in the Garland exclusive interview with Holt, who aired Tuesday night’s episode of NBC Nightly News (mandatory credit) ? Let’s break it down.

Holt started the interview by asking about the ratings in the most general — and unnecessary — terms.

“Just, as an American, can you tell me what your impression was of what we heard?” Holt asked.

MERRICK GARLAND: It’s an important part of democracy, that every American recognizes the truth about what happened on January 6 and the time frame surrounding it. I think that’s an important part that we don’t downplay or take away the importance of this day and I think the auditions did a really good job of reminding us and for people who didn’t know it in the first place , tell us how important it was that day was. And what a risk that posed to our democracy.

Score one for Team Meh, though this brings to mind a great Team Jail moment from a few weeks ago when Garland told reporters “I watch and I will watch all the hearings, although I may not be able to watch everything live. And I can assure you that the January 6 prosecutors are also monitoring all hearings.

Along these lines, Holt then asked “Does the committee offer you anything in terms of an informal roadmap? Do you learn things you didn’t know?

GARLAND: The Department of Justice has conducted the most extensive investigation in its history. And the committee is also conducting an extremely extensive investigation. It is inevitable that there will be things they find before we have found them. And there are, it is inevitable that there are things that we find that they have not found. From the beginning, the Department of Justice has worked to learn all we can about this period and to bring to justice all those who were criminally responsible for obstructing the peaceful transfer of power from one administration to another. , which is the fundamental element of our democracy.

Team Meh will correctly point out that Garland just finished saying exactly the same – the “everyone who was criminally responsible” part – last week, and that’s just another version of the “no one is above the law” mantra that’s been circulating since Nixon. But Team Prison can rightly point out that context matters — when Garland said so last week in response to a direct question about Trump. And he’s said it a bunch of times.

The context here is just as significant, and Garland adds an element that Hold picked up in his next question:

HOLT: You said you were moving fast. There’s been a lot of criticism, a lot of pressure that the DOJ is somehow behind the power curve here, behind the committee, not moving fast enough on what appears to be strong evidence in some cases.

GARLAND: Like I said, we’ve been on the rush from the very beginning, we have a large number of prosecutors and agents working on these cases. It is inevitable in this kind of investigation that there will be speculation about what we are doing, who we are investigating, about our theories. The reason there’s this speculation and uncertainty is that it’s a fundamental tenet of what we do as prosecutors and investigators, is to do it out of the public eye. We do this for two important reasons. One is to protect the civil liberties of the people and events we investigate. And the second is to ensure the success and integrity of our investigation.

It’s pretty much the same he told reporters last the week, and it reads like an elaborate, standard dodge. It can also be read as a stealthy effort to reassure Tem Jail that even though they can’t see the wheels, the wheels are turning.

Next, Holt asked about the Jan. 6 committee issuing a criminal referral, a litigation solution even within the committee:

HOLT: Would a criminal referral by the committee carry a lot of weight, would it be welcomed by the Department of Justice?

GARLAND: So I think it’s entirely up to the committee. We will have the evidence that the committee has presented and whatever evidence they give us, I don’t think the nature of their style, the way the information is provided, is of particular importance from a legal view. This is not to downgrade or denigrate it. It’s just that it’s not what, that’s not the issue here. We are conducting our own investigation, following the principles of prosecution.

This is a deceptively innocuous exchange, and it demonstrates an aspect of this debate that has been overlooked. At first glance, the answer is ambivalent, but all of Garland’s statements can be assessed not only on the basis of what he says or does not say, but on what he could said and did not.

In this case, Garland is clearly not waiving a criminal dismissal from the committee, which he could have done without breaking DoJ standards by noting the need to avoid even the appearance of political consideration.

Speaking of political considerations, Holt raised the specter of division with his next question:

HOLT: You said unequivocally the other day that no one is above the law. That said, the indictment of a former president, possibly a presidential candidate, would undoubtedly tear the country apart. Is that your concern, as you make your decision later here, do you have to think about things like that?

GARLAND: Listen, we seek justice without fear or favor. We intend to hold everyone, anyone who was criminally responsible for the events surrounding January 6, for any attempt to interfere with the legal transfer of power from one administration to another, accountable, that is what we are doing . We pay no attention to other questions in this regard.

HOLT: So if Donald Trump were to run for president again, that wouldn’t change your schedule or how you advance or don’t advance?

GARLAND: I repeat that we will hold accountable anyone who is criminally responsible for attempting to interfere with the transfer, the legitimate and legal transfer of power from one administration to another.

Yes, that sounds familiar, because he said it last week and earlier in the interview. The context here is even more on the nose. And consider what he could said, but did not. At no point does Garland in the least soften the possibility that Trump will not face justice. Not even a clue.

Holt concluded the Jan. 6 track by asking about the growing pressure for an indictment:

HOLT: How does your service handle the pressure? Every day you wake up there’s a column in a newspaper talking about what you’ll do and when you’ll do it.

GARLAND: The only pressure that I or my prosecutors or the agents feel is the pressure to do the right thing. It’s the only way to pursue the rule of law, it’s the only way to maintain the confidence of the American people in the rule of law, which is an essential part of our democratic system.

The garland has said that for months as well, and it’s another one of those inkblots that can look different depending on who’s looking at it. But again, Garland refuses to add anything that might interfere with prompt justice for Trump, such as citing the policy on investigations near or during the election.

From what Garland says, Team Jail has many reasons to feel encouraged, and if you add other factors like RECENT DEVELOPMENTS in the survey, I wouldn’t bet against them.

There is another factor to consider. Garland speaks to multiple audiences whenever he intervenes in insurgency investigations. This includes the 400 pounds. Hearing of one in the room. If this guy is listening, he must hear that Garland is coming for him.
