By a measure, Californians are about 25% less likely to die in mass shootings than residents of other states. Our state low gun death rate is at least in part because of our strict gun laws, experts say.

But after a number of devastating shootings across the United States this year, California is tightening those gun rules even further.

This month alone, Governor Gavin Newsom has signed into law more than 10 new gun restrictions. These include new limits on advertising firearms to minors; increased dealer inspections; and a 10-year firearms prohibition for those convicted of child abuse or elder abuse.

The most high-profile of these laws allows Californians to sue anyone who distributes banned assault weapons or ghost weapons. The legislation, which Newsom signed on Friday, is inspired by a texas law which allows private citizens to sue anyone who aids and abets an abortion.

“If they’re going to use this framework to put women’s lives at risk, we’re going to use it to save people’s lives here in the state of California. That’s the spirit, the principle behind this law,” Newsom said at a news conference on Friday.

The governor’s decision to co-opt Texas’ legal strategy and run ads attacking the Republican governors of Florida and Texas has turned heads in national political circles, my colleague Shawn Hubler explained in his last article.

Today I’m going to tell you what you need to know about California’s latest (and most controversial) gun bill, the cornerstone of the sweeping gun legislation Newsom approved. those last weeks.

Senate Bill 1327 allows Californians to sue anyone who distributes illegal assault weapons, parts that can be used to make weapons, weapons without a serial number, or .50 caliber rifles. The law also allows people to sue licensed gun dealers who sell guns to people under 21.

By law, rewards of at least $10,000 per gun and legal fees will be awarded to successful plaintiffs.

The law is due to come into force in January. But it includes a legal trigger that would automatically invalidate it if the courts struck down the Texas law.

In December, Newsom called for legislation this would allow private citizens to enforce state gun laws.

It was responding to the U.S. Supreme Court ruling refuse to block a texas law which gives people the power to sue anyone involved in someone’s abortion, from the doctor who performs the procedure to the Uber driver who dropped the patient off at the clinic. Under this law, plaintiffs are entitled to $10,000 and their legal costs are recovered if they win.

Newsom appealed to State Senator Bob Hertzberg, a Democrat from the San Fernando Valley, to push the California bill through the Legislature. It was presented in February.

An unusual mix of gun rights groups and the American Civil Liberties Union spoke out against SB 1327.

In a letter opposing the California lawthe ACLU warned that Newsom was reinforcing a legal framework he was trying to condemn.

“We admire and share the Governor’s commitment to reproductive freedom, and we do not dispute his legitimate concerns about the deadly proliferation of illegal firearms. But there is no way to ‘take advantage of the faulty logic’ of Texas law,” the letter read.

The law is expected to face legal challenges that could ultimately land in the Supreme Court.
