Nobody who is the “first” black person to do something has an easy story.

Jackie Robinson faced immense bullying and the spitting of racists. Barack Obama started receiving death threats even before he was the Democratic presidential candidate. Ruby Bridges, a child, was protested, threatened and spat at for trying to attend school.

And, sadly, it won’t be much different for the first black woman to be nominated for the United States Supreme Court. She won’t be able to take her historic place in the highest court in the land without America’s first racists dusting off their usual playbook.

Corn Ketanji Brown Jackson went to Harvard and Harvard Law, was a federal public defender, served as clerk for Judge Stephen Breyer and is currently a federal judge, white conservatives are still throwing adult tantrums at his qualifications.

When Breyer announced his intention to retire and Biden reiterated his campaign promise to appoint a black woman to the Supreme Court, the rumblings began. The idea was that Biden was going to choose someone whose only qualification was his identity.

“If you’re white, bad luck. If you are a white woman, bad luck. You don’t qualify,” Sen. Ted Cruz (R-Texas) noted.

Of 115 justices who have served on the Supreme Court since 1789, only five were women and only three were people of color.

Yet you hardly hear anyone questioning the qualifications of the 110 white Supreme Court appointees. And it’s not because they had more experience. In fact, Judge Jackson’s qualifications surpass some of the current judges on the bench.

“She has more experience as a judge than four of the people who already sit on the Supreme Court, not that we follow.” Sen. Amy Klobuchar (D-Minn.) noted this week.

It’s not really about his credentials, of course. After all, Amy Coney Barrett had much less experience, and Brett Kavanaugh was accused of sexual assault. So instead of just saying they don’t believe Jackson should be confirmed because she’s a black woman, they’re claiming that what they’re saying has merit.

It is unclear who dog whistles are intended for. Their leader, former President Donald Trump, swapped the whistle for a megaphone several years ago; it seemed like we were beyond dressing raw racism in coded terms.

But alas, Fox News’ Tucker Carlson – who never misses an opportunity to be racist – started talking about the LSAT score this week, while mispronouncing his name.

“I wonder how she did the LSATs? Why doesn’t he tell us? That would definitely settle the question of whether she’s a once-in-a-generation legal talent, the next scholarly hand,” he said.

For the uninitiated, the LSAT is the law school entrance exam. I’m no expert, but it’s probably safe to say her score was decent – she attended Harvard. But also, his LSAT score is completely irrelevant.

Not only would Jackson be the first black woman on the Supreme Court, but she would also be the first public defender. These types of lawyers represent the people who cannot afford a private lawyer, which is the vast majority of people charged with crimes in this country. His experience serving the public gives him an edge to see some of the messier parts of the criminal justice system.

But this is not a qualification for conservatives.

As some cities and states face an increase in violent crime, which began in 2019, Republicans are taking the opportunity to reinvigorate “soft on crime” attacks. And who better to blame than a black man?

“The Senate must conduct a rigorous and comprehensive review of Justice Jackson’s nomination to the Supreme Court,” said Sen. Mitch McConnell (R-Ky.) tweeted last month. “This is especially crucial as American families face major crises directly related to our legal system, such as skyrocketing violent crime and the opening of borders.”

There’s that dog whistle again.

He explained in a longer statement this week. “This is a time when issues of law and justice are hitting American families directly – murders and skyrocketing carjackings; lenient crime prosecutors effectively repealing laws; to open the borders,” Senator McConnell noted. He also hinted that Justice Jackson is a left-wing radical backed by “fringe” groups – liberals who want to expand the Supreme Court.

“It’s a matter of record that this candidate was the anointed favorite of these fringe groups…. I therefore intend to explore why the groups waging a political war against the Court as an institution have decided that Judge Jackson is their favorite.

But there is no indication that the judge’s legal opinions are anything other than the prevailing liberal policy.

The GOP attacks on an obviously qualified judge are another reminder that respectability policy are a useless framework. Judge Jackson has two degrees from Harvard and is still accused of not having the qualifications to be a Supreme Court judge. It’s almost as if this isn’t all about who has the qualifications, but rather who the right thinks deserves to hold the power.

You’d think the Republicans just aren’t in the mood for all-out war on Jackson. After all, his nomination won’t tip the scales on the Conservative court, and there are more pressing matters, like the midterm elections this fall, to ponder.

So why are conservatives looking for ways to discredit Judge Jackson? Why do Republicans launch the same tired attacks every time a person of color is about to smash through a glass ceiling?

Conservatism, at least in the United States, is repelled by multiracial democracy and black equality. The answer is therefore simple. They are morally opposed to the idea of ​​a black woman in power.

Fortunately for those who root for the right side of history, Ketanji Brown Jackson, like Robinson, Obama and even Bridges before her, is ready for this fight.
