A federal judge on Wednesday appointed a so-called special master to determine whether documents seized by the FBI from current and former Project Veritas employees can be used by prosecutors as evidence in their investigation into the apparent theft last year. from a diary kept by President Biden’s daughter. .

The ruling by U.S. District Court Judge Analisa Torres was a victory for Project Veritas, the conservative group that has come under scrutiny in recent weeks by the U.S. Attorney’s Office in Manhattan as ‘he’s investigating how Ashley Biden’s diary made its way to Project Veritas in the weeks leading up to Election Day last year.

Despite a ruling in favor of Project Veritas, Judge Torres refused a request by the group to order the Justice Department to investigate the leaks to find out who provided information about the searches to the New York Times, who reported shortly after they happened in early November.

In appointing the special master, Judge Torres acknowledged that federal prosecutors themselves could conduct the examination “with the greatest of integrity.”

But she said the appointment of a special master was justified because it was important both for the process to be fair and for it to appear fair.

“In light of the potential First Amendment concerns that may be involved in reviewing documents seized from petitioners, the court finds that the appointment of a special master” will help protect public confidence in the administration of the justice, ”said the judge.

Barbara S. Jones, a retired former Manhattan U.S. District Court judge who now works as a private attorney, will serve as a special master, Justice Torres said.

It is common for special masters to be appointed in high-profile investigations, where authorities may have obtained documents that the government is often prohibited from having because they are protected by solicitor-client privilege. A special master was appointed earlier this year to determine what evidence prosecutors can use that they obtained during a search of the home and office of Rudolph W. Giuliani, who served as personal counsel for President Donald J Trump.

Federal prosecutors and FBI agents have investigated the role Project Veritas may have played in any theft of the newspaper. Project Veritas admitted paying to obtain the newspaper but said it was assured by the individuals who sold it to the group that they had legally acquired it.

Project Veritas has sought to portray itself as a journalistic organization whose First Amendment rights are violated by an overzealous Justice Department. An attorney for the group praised the decision in a tweet, saying it was a sign the group’s First Amendment rights were protected.
