ATLANTA – As final arguments in the trial of the men charged with the murder of Ahmaud Arbery loom, the defense attorney who has drawn widespread criticism for trying to keep black preachers like Reverend Al Sharpton out of the room The hearing asked for an annulment of the trial on Friday, arguing that the protesters outside the courtroom were a “waking left-wing crowd” who unduly influenced the jury.

Friday’s motion to quash was among those brought or threatened in recent days by Kevin Gough, the attorney for William Bryan, one of three white men charged with unlawfully prosecuting and murdering Mr. Arbery , a 25-year-old black man. Like other similar requests to quash Mr. Gough’s trial, this one was dismissed by Judge Timothy R. Walmsley of the Glynn County Superior Court.

But Mr Gough – who said earlier this week: “We don’t want black pastors coming here anymore” – took his provocative language to new heights on Friday.

Mr Gough noted the large crowd of black pastors and other civil rights protesters who gathered outside the courthouse in Brunswick County, Georgia on Thursday. “This is what a public lynching looks like in the 21st century, with all due respect,” he said. .

Civil rights leaders like Mr. Sharpton have called Mr. Arbery’s murder in February 2020 a lynching. Mr Gough appeared to be speaking figuratively as there were no reports of violence or threats from people who gathered outside the courthouse.

In arguing against the quashing of the trial, Linda Dunikoski, the lead prosecutor in the case, called Mr. Gough a “brilliant lawyer”. She noted that it was Mr Gough himself who was responsible for drawing a large crowd on Thursday when he made the controversial argument that pastors like Mr Sharpton and Reverend Jesse Jackson should be held to away from the courtroom.

Mr. Gough’s words were, indeed, the catalyst for the peaceful protest. One of the participants, Jamal H. Bryant of Georgia, reportedly called Mr. Gough’s comments “absolutely unnecessary, distracting and polarizing”. Mr Jackson defiantly declared: “We will continue until justice is done” according to the Associated Press.

The three white men, who said they believed Mr. Arbery was responsible for breaking into their neighborhood, were charged with malicious murder, criminal murder, aggravated assault, forcible confinement and criminal attempt to commit a crime. They risk life imprisonment. A jury made up of 11 whites and one black will hear the pleadings of the case Monday morning, then begin deliberations.

The jury was not in the courtroom on Friday. But lawyers have spent the day fighting intensely over the language of the instructions Judge Walmsley will read to jurors before deliberations begin.

CBS News reported On Friday, S. Lee Merritt, an attorney for the Arbery family, said Mr. Bryan’s defense team asked the Cobb County District Attorney’s Office for a plea deal, but prosecutors rejected it.

Mr Gough, in a brief interview with The New York Times on Friday morning, denied that his client had sought a plea deal. A spokesperson for the prosecution declined to comment.
