Like almost all subjects these days, the story of Kyle Rittenhouse cut along partisan lines. The conservative media have come to his defense, some almost deified him, while he was vilified by mainstream left-wing media with coverage that was beyond dishonesty.

That being said, right-wing media omitted key details from their coverage of Rittenhouse, who is on trial for shooting three people, killing two of them, during last summer’s riots in Kenosha, Wisconsin, after the police shooting Jacob blake.

While the right-wing media have rightly focused on the fact that Rittenhouse appears to have fired shots in self-defense – as the videos show him doing against agitators, including one who tried to come and get his gun – other facts also show that Rittenhouse was not absolutely innocent in his actions on that fateful night of August.

While Rittenhouse is likely acquitted of the homicide charges, he should never have been in Kenosha in the first place. So much for the Conservatives advocating the principle of individual responsibility.

For one thing, Rittenhouse was 17 and carried a firearm – a violation of Wisconsin law, which prohibits minors from having a firearm except for hunting purposes. One of six charges Rittenhouse faces possession of a dangerous weapon by anyone under the age of 18. Those convicted of the misdemeanor charge face up to nine months behind bars.

Second, although the seventh and final charge – refusal to follow the 8-hour curfew put in place by Kenosha County in response to the protests and riots that followed Blake’s shooting – was dismissed by the judge in the case, Rittenhouse violated the curfew even if not in the legal sense. The videos obviously show that he was on the streets in violation of the curfew.

Third, while Rittenhouse could be acquitted of the charges of killing these two people because he had done so in self-defense, he could still be found guilty of reckless endangerment in the first degree with the use of ‘a dangerous weapon. Daily Caller Video Journalist Richard McGinnis testified that he was in the crosshairs when Rittenhouse shot the first victim, Joseph Rosenbaum.

Even if Rittenhouse is acquitted of the homicide charges, that doesn’t necessarily mean he will be acquitted of the first degree reckless endangerment charge, which carries a maximum sentence of 17.5 years in prison.

“It’s a complicated question,” said a Wisconsin criminal lawyer. Antoine Jurek said Mediaite.

“Self defense, as it is written, is a positive defense against any crime,” he said. “And so, hypothetically, it could be used, but besides, as it is written, I think that what the [Wisconsin] the legislature intended that it could be applied in circumstances such as when someone attacks you.

In other words, Jurek said, “this is an open question that the parties are discussing in the Rittenhouse case” and therefore, he added, “I don’t think we can safely assume “only if Rittenhouse is acquitted of reckless endangerment in the first degree.

Jurek noted that following the arguments, the jury will be instructed, that the prosecution and the defense will discuss whether self-defense should be a factor in the deliberation of the charge of reckless endangerment. in the first degree.

However, the Milwaukee-based criminal defense attorney Matthew Meyer told Mediaite that the use of the excuse of self-defense cannot be used against the charge of reckless endangerment in the first degree (or second degree). He said that self-defense “requires a sort of direct action” of intentionally targeting someone while “recklessly endangering safety … focuses on reckless driving”.

“It’s more of a negligence type offense where I do something that is not directed at someone else but puts someone else in danger,” he said.

Wisconsin-based criminal defense attorney Sarah schmeiser told Mediaite: “Because Kyle Rittenhouse is charged with two counts of reckless endangerment of first degree security as well as varying degrees of homicide, yes he can be convicted of reckless endangerment. to first degree security on these counts and acquitted on separate homicide counts. “

The right, including its media ecosystem, likes to preach the need to protect law-abiding citizens and hunt down those who break the law. Sticking to ideological and journalistic principles should be blind to any subject – such as the administration of justice. The Rittenhouse case is no exception in this regard.
