The Biden administration has asked a federal appeals court to let the government follow through on a federal mandate that all major employers require their workers to get their coronavirus shots or take weekly tests starting in January .

In a 52-page movement filed Tuesday, the Justice Department urged the U.S. Court of Appeals for the Sixth Circuit in Cincinnati to lift a judicial stay of proceedings while it is challenged in court, saying the requirement “Would save thousands of lives and prevent hundreds of thousands of hospitalizations.

The Occupational Safety and Health Administration, or OSHA, issued the “emergency” rule earlier this month under President Biden as one of the many vaccine mandates he announced in September. The OSHA rule applies to employers of at least 100 workers, although it exempts those who work from home or exclusively outdoors.

The rule was immediately challenged by employers across the country and several Republican-controlled states. In court documents, they argued that the rule exceeded the agency’s power under the law to make regulations to protect workers from toxic hazards in the workplace, arguing that the law was intended to combat them. dangerous substances like asbestos but not exposure to the virus.

Earlier this month, a three-judge panel from the Fifth Circuit Court of Appeals in New Orleans ruled in favor of the plaintiffs in several of the cases and temporarily prevented the government from applying the rule. But since then these and many more cases across the country have been reassigned to the Sixth Circuit in order to consolidate the dispute.

“The suspension of the fifth circuit must be lifted immediately,” the justice ministry said in its file. “The main rationale for this tribunal was that OSHA would not have had the legal authority to deal with the serious danger of COVID-19 in the workplace on the grounds that COVID-19 is caused by a virus and also exists in outside the workplace. This justification has no basis in the statutory text.
