For two weeks, jurors in the Kyle Rittenhouse homicide trial sat silently in a courtroom in Kenosha, Wisconsin, witness after witness describing the deadly chaos that unfolded in the city in August 2020.

Outside the courtroom, commentators from across the political spectrum weighed in on which side appeared to be the most persuasive. But the only opinions that ultimately matter belong to the 12 residents of Kenosha County who entered the deliberation room to discuss evidence from the closely watched trial.

The 12 were ordered to consider only the information presented in court – and to ignore the constant media coverage and political commentary on Mr. Rittenhouse’s actions and affiliations, some of which were prevented by the judge to be discussed in the courtroom.

“You should not rely on any private information source”, the Wisconsin Jury Manual says, “although it is assumed that you will use your own experiences, knowledge and common sense to reach your conclusions.”

Discussions in the jury room are prohibited for everyone except the jurors themselves. Once entered the room, the jurors would have chosen a foreman or a foreman to direct the deliberations, which must be “sensitive and orderly”, according to the directives of the state.

Jurors can take as long or as little time as they need to reach a verdict. On Tuesday, the first day of deliberations, they requested copies of the first part of the jury’s instructions which relate to self-defense, and then later requested the remainder of the instructions.

A verdict on any charge must be unanimous – all 12 jurors must agree. They are asked to listen to opposing arguments in the deliberation room and be prepared to change their minds if they find these arguments convincing. The judge told the jury before deliberations began that they had the opportunity to consider less serious charges on each count.

If the jurors cannot come to an agreement to convict or acquit on a particular charge, the jury is said to be hanged and the judge can declare the trial quashed. If this happens, prosecutors must decide whether to drop the charge or continue with another trial.
