The Biden administration is “ready to defend“Sweeping new coronavirus vaccine rules for big business amid new legal challenges,” Surgeon General Dr Vivek Murthy said on Sunday.

Administration last week set January 4 as the deadline for companies with 100 or more employees to impose Covid vaccinations or implement weekly tests for workers. The warrant would allow medical or religious exemptions, and companies that do not comply can be fined.

“The president and administration wouldn’t have put these requirements in place if they didn’t think they were appropriate and necessary,” Dr Murthy told ABC’s “This Week”.

Dr Murthy pointed to the nation’s history as precedent: George Washington obligatory troops to be vaccinated against smallpox in 1777.

The sweeping move has already raised legal challenges, with opponents arguing the requirement is unconstitutional. A coalition of businesses, religious groups, rights organizations and several states filed a petition Friday with the United States Court of Appeals for the Fifth Circuit in Louisiana, arguing that the administration had exceeded its authority.

Saturday, a tribunal panel Temporarily blocked the new mandate, writing “The petitions suggest that there are serious statutory and constitutional problems with the mandate.”

The stay has no immediate impact, as the rule’s first major deadline is December 5, when companies with 100 or more employees must require unvaccinated employees to wear masks indoors. But this decision gives impetus to opponents of the mandate.

The legal challenge is whether the Occupational Safety and Health Administration has the power to issue the rule, or whether such a mandate needs to be passed by Congress.

It was not clear whether the suspension would be a procedural incident for the Biden administration or the first step in the mandate unfolding. A separate lawsuit against the warrant was filed on Friday to the United States Court of Appeals for the Eighth Circuit in St. Louis by 11 Republican-led states.

So far, legal challenges to vaccine warrants have fell short.

White House chief of staff Ron Klain said on Sunday he was “fairly confident” that the tenure would be maintained in a maintenance on NBC’s “Meet the Press”.

“If OSHA can tell people to wear hard hats on the job, to watch out for chemicals, they can put these simple steps in place to keep our workers safe,” Klain said.
