The committee proposed removing the NCAA’s existing and detailed non-discrimination pledge from the constitution, drawing criticism from groups like the Human Rights Campaign and Athlete Ally. The leaders of these organizations, Joni Madison and Hudson Taylor, urged NCAA leaders last week to include an “enumerated policy providing protections against discrimination to all athletes.”

Gates argued that the project’s provisions on diversity and gender “are quite strong statements that discrimination will not be tolerated.”

These Sections state that the NCAA is “committed to diversity and inclusion,” state that conferences and schools “create diverse and inclusive environments” and that divisions, conferences and schools have a responsibility to follow laws regarding gender equality. College athletic activities, the project adds, “will be conducted in a manner free of gender bias,” a topic that has surfaced widely this year after disparities between the Division I men’s and women’s basketball tournaments.

But some long-standing NCAA systems and policies are likely to stay the same or close. A 1996 formula for the income allocation for Divisions II and III, for example, will likely remain unchanged, largely because schools in those divisions control most of the votes within the NCAA.

No. Ten Conferences and Notre Dame run the playoffs, and the NCAA has no control over it.

Any change to Division I could ultimately influence the playoffs and the universities that reach it, but the word “playoffs” doesn’t even appear in the draft constitution.

Mainly because he realizes he doesn’t have a lot of choice.

The NCAA has been a legal pin for years, and it has recently come under intense scrutiny not only by the courts, but politicians at the state and federal levels as well. The Supreme Court’s ruling this summer, however, alarmed many industry officials as it made the NCAA even more vulnerable to challenges under antitrust law.

The pressure to rewrite the constitution amounts to an effort to give the NCAA greater legal coverage, although Gates denied that this was the association’s primary motivation. Regardless, some researchers are skeptical of the NCAA’s significant improvement in its legal position and believe the association will always end up fighting many court battles.
