The law at issue was the latest in a decade of efforts by Republicans in the state General Assembly to require voters to present identification, a cause the National Republican Party had embraced as an anti-fraud measure, although studies have shown that election fraud is extremely rare.

An identity law passed in 2011 was vetoed by the state’s Democratic Governor, Beverly E. Perdue. A second version, adopted in 2013 after the United States Supreme Court overturned the core of the 1965 Voting Rights Act, relied on state data to compile a list of exhibits. identity requirements that were disproportionately lacking from black voters, and excluded those they often held.

After this law was struck down in 2016, the Legislature proposed an amendment to the state’s constitution requiring voters to present identification at the polls. And when voters approved the amendment in the 2018 general election, the legislature called a lame duck session to enact legislation setting out specific photo ID requirements.

A legal advocacy group, the Southern Coalition for Social Justice, filed a lawsuit on behalf of five voters to overturn the law. At a trial in April, lawyers for the Republican-controlled Legislature argued that the new law was not only much less stringent than the one struck down by the federal court, but included a black Democratic lawmaker as its sponsor.

The 2018 law accepted valid student and tribal ID cards that the 2013 law excluded, made free ID available at driver’s license and election offices, and allowed voters who did not have still no photo ID to vote on provisionally.
