Opening statements in the case of Elizabeth Holmes, the founder of blood testing startup Theranos, is set to begin in San Jose, Calif. on Wednesday morning, kicking off one of Silicon Valley’s most anticipated trials.

Ms Holmes, 37, has been charged with 12 counts of wire fraud and conspiracy to commit wire fraud in connection with the money she raised for Theranos, who dissolved in 2018 after her blood tests turned out to be having problems.

A jury will decide whether Ms. Holmes, who founded Theranos in 2003 and made it her mission to revolutionize healthcare, lied to investors about her company’s technology.

Ms Holmes claimed that Theranos’ machines, called Edison, could quickly perform a wide range of blood tests using just a drop of blood. The United States accused Ms Holmes of knowing the tests were limited and unreliable, harming patients who used them. Prosecutors also said she overestimated the trade deals and Theranos’ performance.

Former Theranos chairman Ramesh Balwani, known as Sunny, is on trial in a separate case set to start next year. Ms Holmes and Mr Balwani have pleaded not guilty. Judge Edward Davila of the U.S. District Court for the Northern District of California is presiding over the cases.

If found guilty, Ms Holmes could face up to 20 years in prison, which would make her one of the few leaders in Silicon Valley accused of wrongdoing of going to jail.

The lawsuit ends years of delays and legal wrangling over issues such as emails and arguments that can be used and whether Ms Holmes should be required to wear a mask when sitting in the room. hearing.

Last week a jury of seven men and five women was sworn in after eliminating many potential jurors who had heard of Ms Holmes, had direct experience of domestic violence, or had schedules that could not accommodate the three-month trial.

Lawyers for Ms Holmes have indicated they could use a mental health defense, arguing Mr Balwani, who she was dating, was emotionally and physically abusive. Mr. Balwani denied the charges. Ms Holmes’ attorneys also indicated in court documents that she is likely to testify.

In court documents filed over the weekend, prosecutors listed more than 200 potential witnesses, including David Boies, the former lawyer for Theranos; Henry Kissinger, the former secretary of state who sat on Theranos’ board of directors; James Mattis, former Secretary of Defense and Director of Theranos; and Rupert Murdoch, the media mogul, who supported Theranos and was part of a trial on his disappearance. Some names were displayed as initials.

Ms. Holmes’ attorneys have listed more than 60 witnesses, including several of the US attorneys handling the case; John Carreyrou, reporter and author of a book on Theranos; William Frist, the former US senator who sat on Theranos’ board of directors; and Mrs. Holmes.

In a separate file, lawyers for Ms Holmes also requested that the testimony of three former Theranos employees be excluded. One of the witnesses, Erika Cheung, worked in Theranos’ lab and reported problems with her blood tests to federal regulators. Counsel for Ms. Holmes argued that various parts of Ms. Cheung’s testimony would be irrelevant, based on hearsay, or not directly related to Ms. Holmes.

Lawyers for Ms Holmes have also asked to exclude testimony from Daniel Edlin, the company’s former project manager, and Danise Yam, Theranos’ corporate controller for 11 years.

Prosecutors responded with material supporting Ms. Cheung’s claims. On Tuesday, Judge Davila ordered such an exclusion to be “premature” before hearing questions or arguments from the government.
