The administration’s legal maneuvers may have failed, but they saved time for tenants threatened with eviction. In unusually candid remarks this month, President Biden said it was part of his calculation to decide whether to proceed with the new moratorium, which was due to expire on October 3.

Congress declared a moratorium on evictions at the start of the coronavirus pandemic, but it lapsed in July 2020. The CDC then issued a series of its own moratoria, saying they were justified by the need to fight pandemic and authorized by a law of 1944.. People unable to pay their rent, the agency said, should not be forced to crowd in with relatives or take refuge in homeless shelters, spreading the virus.

The latest moratorium – which was put in place by the CDC in September and expired on July 31 after being repeatedly extended by Congress and Mr Biden – succeeded in meeting its target, cutting the number of eviction cases that would normally have been filed since last fall, according to a file analysis by the Princeton University eviction lab.

Corn owners said the moratoria had put them in billions of dollars in debt. The challengers in the current case – homeowners, real estate companies and trade associations led by the Alabama Association of Realtors – argued that the moratorium was not authorized by the law the agency was relying on, the Public Health Service Act of 1944.

This law, the challengers wrote, dealt with quarantines and inspections to stop the spread of disease and did not give the agency “absolute power to take any action imaginable to stop the spread of communicable disease – let it be. act of expulsion moratoriums, cult limits, nationwide closures, school closures or vaccination warrants. ”

The CDC responded that the moratorium was authorized by the 1944 law. The evictions would speed up the spread of the coronavirus, the agency said, forcing people “to move, often to nearby neighborhoods in new homes shared with friends. or family, or to come together such as homeless shelters ”.

The moratorium, the administration told judges, was largely similar to the quarantine. “It would be strange to argue that the government can fight the infection by banning the tenant from leaving their home,” her brief said, “but not by banning the landlord from throwing it out.”
