At least 2,700 lawsuits and hundreds of thousands of claims have been filed against Purdue, starting in 2014 when the opioid epidemic began to peak. The plaintiffs cover a wide range of 48 states, local governments, tribes, hospitals, individuals and monitors of infants born with symptoms of opioid withdrawal, all of whom have been ravaged and financially depleted by opioids.

In recent years, Sacklers themselves have been named in an increasing number of cases.

Almost two years ago, Purdue filed for bankruptcy, which automatically stayed those lawsuits. But the Sacklers themselves did not file for bankruptcy, although they insisted that they too should benefit from the liability waivers that should be granted to their company.

The issue of the releases of Sacklers and other third parties is at the heart of resistance to the bankruptcy plan now being pursued by nine states, including Maryland, Washington and Connecticut. The District of Columbia, the Federal Department of Justice and the U.S. Trustee, a Department of Justice program that monitors bankruptcy cases, as well as some local governments and Canadian First Nations, have joined in the objections.

Under the law in the First Circuit Court of Appeals, in which Judge Drain’s court is located, the judge can grant releases to the Sacklers and other third parties who have not filed for bankruptcy. But, generally speaking, the question is not settled.

Other federal circuits forbid it. The issue has been addressed by members of Congress and may well lead to an appeal from opponents, if Judge Drain upholds the plan. The hammered questions posed by opposing lawyers have so far not only been intended to raise questions about the plan, but also to lay the groundwork for such appeals.
