President Biden’s climate plans may soon move forward in the administrative state, and the place to watch is the Federal Energy Regulatory Commission, or FERC. This obscure organization oversees America’s gas pipelines and electricity markets, and Democrats are poised to take control.

Since Mr. Biden’s inauguration, FERC has operated with a 3-2 Republican majority. That will change on Monday, when GOP commissioner Neil Chatterjee resigns. Although Mr Chatterjee’s official term expired on June 30, the rules allow him to remain on borrowed time. Mr Biden has not named his replacement, but the stakes are high considering what FERC might do next.

Even under GOP control, the past few months have been trying. At FERC acrimonious meeting in May, two minor natural gas projects nearly derailed due to climate change. Northern natural gas sought a new compressor station, with a few other odds and ends. Tuscarora Gas Transmission wanted replace a compressor unit while doubling its power. Everyone agreed that these projects were worth it, and they ended up going 3-2.

But the two democratic commissioners dissidentbecause the proposals were not accompanied by environmental impact studies to assess their effects on the climate. What if a study predicted significant emissions? It would not be “the death knell” of a project, argued Democrats, because the developer could still suggest ways “to mitigate these negative impacts.”

Here’s a glimpse of the future: In February FERC publish a review seek “stakeholder views” on how to revise its approval process for new natural gas projects. He specifically cited the public interest in “how the Commission is tackling climate change”. Building natural gas pipelines in the future is likely to require more study and green indulgences, assuming the project is not killed upfront.
