IRS Must Submit Trump's Tax Returns to Congress, Says DoJ | Donald trump

The US Department of Justice on Friday ordered the Internal Revenue Service to turn over Donald Trump’s tax returns to a House committee, saying the panel had “given sufficient reasons” to request them.

The news was a second blow to Trump in hours, after published DoJ memos revealed that as part of his campaign to reverse his electoral loss to Joe Biden, he pressured senior officials to falsely label the 2020 election as corrupt and then “leave the rest to me.”

House Speaker Nancy Pelosi applauded the DoJ’s order for the IRS to release Trump’s tax returns to the Ways and Means Committee.

“Today, the Biden administration has achieved a victory for the rule of law because it respects the public interest by complying with the president’s directives [Richard] Neal is asking for Donald Trump’s tax returns, ”Pelosi said in a statement.

“Access to former President Trump’s tax returns is a matter of national security. The American people deserve to know the facts of their troubling conflicts of interest and to undermine our security and democracy as President. “

Presidential candidates traditionally disclose their tax returns, although they are not legally required to do so. Trump kept his out of public view when he showed up to the White House in 2016, claiming they were subject to an IRS audit and had not released them during their tenure.

After the Democrats took control of the House in 2018, amid the investigation into Russian election interference and Trump-Moscow ties by Special Advisor Robert Mueller, they began to search for the cases in front of courts.

Trump fought to keep his tax returns out of public view, but the New York Times got it some of the recordings, which showed that Trump had paid next to nothing in federal income taxes in the years before he entered the White House.

In a Friday memo, the DoJ’s legal counsel’s office said Neal, the Massachusetts congressman who chairs the Ways and Means Committee, had “given sufficient reasons to request the former president’s tax information.” .

Under federal law, the OLC said, the Treasury Department “must provide the information to the committee.”

The 39-page memo was signed by Dawn Johnsen, installed by the Biden administration as the acting chief of the OLC.

Trump’s Treasury Secretary Steven Mnuchin has said he will not hand over Trump’s tax returns because they are wanted for partisan reasons.

The House Ways and Means Committee has filed a lawsuit for the records under a federal law that requires the IRS to “provide” any taxpayer’s returns to a handful of prominent lawmakers. The committee said it needed Trump’s taxes for an investigation into whether he had complied with tax law.

Trump’s Justice Department defended Mnuchin’s refusal and Trump intervened to try to prevent the documents from being turned over to Congress. Under a January court order, Trump would have 72 hours to object after the Biden administration formally changed the government’s position in the lawsuit.

Bill Pascrell, a Democrat from New Jersey who chairs the House Ways and Means Subcommittee on Oversight said, “It is high time. Our committee first requested Donald Trump’s tax returns on April 3, 2019 – 849 days ago. Our request was made in full accordance with the law and in accordance with the constitutional oversight powers of Congress. “

Daniel Goldman, a lawyer who advised Democrats on Trump’s first inquiry and impeachment trial, noted: “The old OLC opinion supporting Mnuchin’s ability to withhold Trump’s tax returns was perhaps the most blatant and unfounded opinion of many bad ones during the Trump era.”

Michael Stern, Former Senior Counsel at the House Office of General Counsel, says Politico Trump had options to stop publishing his returns.

“I think Trump will have an opportunity to file a new case or to file something in this case in which he sets out his legal grounds for objecting to the filing of his tax returns,” he said, adding : “It’s certainly not over yet.”

Elsewhere, Manhattan District Attorney Cyrus Vance Jr obtained copies of Trump’s personal and professional tax records as part of a criminal investigation.

Trump tried to prevent his accountants from handing over the documents, taking the case to the Supreme Court. The judges rejected Trump’s argument that he had broad immunity as president.

Speaking to Reuters about the DoJ order, Richard Painter, a University of Minnesota law professor and George W Bush ethics counselor, said it appears Biden’s justice department ” no longer just bow down to Donald Trump. “

“All the other presidents have disclosed their tax returns,” he said, “and find out what conflicts of interest are on the president or a former president who may have made decisions that now need to be reconsidered – this is extremely important. “
